How Pre-Settlement Funding Works

The Four Steps, and What Each One Actually Involves

1. The first conversation. A phone call, usually under ten minutes. We ask what happened, where your treatment stands, who represents you and roughly what you need. Nothing is asked about your credit or your income, because neither is what repays the advance.

2. We contact your attorney. This is the part that takes the longest, and it is almost entirely outside your control. We need the claim confirmed — liability, the injury, where the case stands — and that depends on how quickly your attorney's office responds. A firm that answers the same day means funding the same week. If your attorney knows the request is coming, it moves faster, which is why it is worth mentioning to them before you call.

3. The offer. If the case supports an advance, we tell you the amount and exactly what will be repaid from the settlement. You see the figure in dollars before signing anything, not a percentage to work out yourself. If it does not suit you, you decline and nothing further happens.

4. The money. Once the agreement is signed by you and acknowledged by your attorney, funds are released. Approval can happen in as little as 24 hours where the attorney responds promptly.

What Slows an Application Down

Being honest about this is more useful than promising speed. Three things account for almost every delay:

• Waiting on the attorney's office. Comfortably the most common. We cannot confirm a claim without them, and a busy firm may take several days to respond to a funding request.
• Treatment still at an early stage. If the medical picture is not yet clear, the value of the claim is not either, and it may be better to wait than to take a smaller advance now.
• An unresolved question on liability or coverage. A disputed account of the accident, or an at-fault driver whose insurance position is unclear, has to be worked through before anyone can size an advance.

If the Answer Is No

Not every claim can be funded, and you should know what that means before you apply.

A decline is usually about the claim's stage or its structure rather than its merit. The case may be too early, the injury may not clear Michigan's threshold for a third-party claim, or there may be no realistic source of recovery at the end — a strong claim against an uninsured driver with no assets is still a claim nobody can fund.

If we decline, we will say why, and we will say whether it is worth coming back later. A case that is too early in March may be perfectly fundable by September. Nothing is charged either way, and a decline leaves no mark on your credit, because we never looked at it.
